Detrimental Use of Right-of-Way along County Highways is Illegal

Instances have come to the attention of the Brookings County Highway Department of violation of South Dakota Compiled Laws 22-34-27 and 31-32-16/17/18. These statutes apply to any public highway, state, county, city or township, within Brookings County.  The piling of snow on such roads or within the right-of-way there of causes serious hazard and may constitute a misdemeanor.

These piles of snow can cause serious injuries or fatalities if hit by a vehicle.  They also cost the county funds to remove or push back the piles.  Because they become very solid and at times contain debris, serious damage to county snow removal equipment can result.  

The county may bill the cost of equipment damage to the person piling up this snow.  The person performing this misdemeanor who may legally be liable in the event of a vehicle accident.  Please flatten out any piles you may have place on county roads.
